These Terms and Conditions (hereinafter "Terms") apply to all users (hereinafter "Users") of the Circu App mobile application (hereinafter "App") and all associated services provided by Circu App (hereinafter "Operator"). Any conflicting or differing terms of the User are hereby expressly rejected, unless expressly agreed otherwise in writing.
To use the App, you must be at least 18 years old. By registering, you confirm that you meet this age requirement.

You are responsible for maintaining the confidentiality of your account login information and for all activities that occur under your account. You agree to notify the Operator immediately of any unauthorized use of your account.
Creating multiple accounts is prohibited.
You may terminate your account at any time by navigating to "User Profile" and selecting "Delete Account" or sending an email request to our mail. Upon termination, your data will be handled according to our Privacy Policy.
The Operator reserves the right to suspend or terminate your account, with or without notice, if you violate these Terms, engage in fraudulent or illegal activities, or for any other reason deemed necessary to protect the integrity of the App or other users.

The App uses your device's location services to show you events happening around you. By enabling location services for the App, you consent to this functionality. You can disable location services at any time through your device settings, but this may limit the App's functionality.
Users can create activities by providing details such as activity type, time, location, description, and specific requirements for participants.
The App facilitates connections between users by comparing specific requirements and preferences provided by users. This matching is solely based on data explicitly provided by users for this purpose.
The Operator does not guarantee any successful matches or participation in activities. The effectiveness of the matching service depends on the information provided by users and the availability of suitable matches.
You agree to use the App only for lawful purposes and in accordance with these Terms. You shall not use the App to engage in any activity that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.
You agree to provide accurate, current, and complete information when creating activities, setting preferences, and interacting with other users.
You agree to interact with other users in a respectful and appropriate manner. Harassment, discrimination, hate speech, or any form of disrespectful behavior is strictly prohibited.
You are solely responsible for all content you upload, post, or transmit through the App, including but not limited to activity descriptions, comments, and profile information. Your content must not:

The App is intended for personal, non-commercial use only. You may not use the App for any commercial purposes without the express written consent of the Operator.
We collect and process your personal data in accordance with our Privacy Policy and the General Data Protection Regulation (GDPR). We only use user data to match requests and facilitate interactions within the App.
Your user data, including data used for matching, is strictly NOT shared with any third parties outside of the direct operation and functionality of the App as described in these Terms and our Privacy Policy.
Our Privacy Policy, available at Privacy Policy, explains in detail how we collect, use, store, and protect your personal data. By using the App, you agree to the terms of our Privacy Policy.
You have certain rights regarding your personal data, including the right to access, rectification, erasure, restriction of processing, data portability, and objection. Please refer to our Privacy Policy for more information on how to exercise these rights.
All content and materials available on the App, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, and software, are the property of the Operator or its licensors and are protected by German and international copyright, trademark, and other intellectual property laws.
By uploading, posting, or transmitting any content to the App, you grant the Operator a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, and publicly display such content in connection with the operation and promotion of the App. This license terminates when you delete your content or your account, unless your content has been shared with others and they have not deleted it.
You may not copy, reproduce, distribute, transmit, broadcast, display, sell, license, or otherwise exploit any content on the App for any purpose not expressly permitted by these Terms without the prior written consent of the Operator.
The App and its services are provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
The Operator is not responsible for the conduct of any users or the content they create or transmit. You acknowledge that you interact with other users at your own risk.
While the App facilitates the discovery and creation of events and activities, the Operator is not responsible for the safety, legality, or quality of any events or activities organized or attended by users. You participate in such events at your own risk.
To the maximum extent permitted by applicable law, the Operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the App; (b) any conduct or content of any third party on the App; (c) any content obtained from the App; or (d) unauthorized access, use, or alteration of your transmissions or content.
The limitations of liability in Section 7.4 do not apply to damages caused by intentional misconduct (Vorsatz) or gross negligence (grobe Fahrlässigkeit) by the Operator, or to damages resulting from injury to life, body, or health. Liability under the German Product Liability Act (Produkthaftungsgesetz) remains unaffected.
You agree to indemnify, defend, and hold harmless the Operator, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that arise from your use of the App, your violation of these Terms, or your infringement of any rights of a third party.
The Operator reserves the right to modify or revise these Terms at any time. We will notify you of any material changes by posting the updated Terms on the App or by sending you an email notification. Your continued use of the App after the effective date of the revised Terms constitutes your acceptance of the changes.
10.1. Governing Law: These Terms and any disputes arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law principles. The UN Convention on Contracts for the International Sale of Goods (CISG) shall not apply.
10.2. Jurisdiction: The exclusive place of jurisdiction for all disputes arising from or in connection with these Terms shall be Hamburg, Germany, provided that the User is a merchant (Kaufmann) in the sense of the German Commercial Code (Handelsgesetzbuch), a legal entity under public law, or a special fund under public law. If the User is a consumer, the statutory provisions regarding jurisdiction apply.
If any provision of these Terms is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.
